US Court Mandates Freedom of Kilmar Abrego Garcia from ICE Detention
A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment is without legal authority.
"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The case stems from a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an mistake. Following his return to the United States to face alien smuggling charges, he was held in federal custody.
In her order, the court noted that the authorities lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

The court proceedings involve conflicting assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.
He has also pleaded not guilty to the smuggling counts, which are part of a separate trial in Tennessee.
